حماية البيئة ضمن قانون المحروقات الجزائري Environmental Protection Within The Algerian Hydrocarbons Law

الملخص
أولى المشرّع الجزائري أهمّية كبيرة لقطاع المحروقات، وذلك لأهمّيته في الاقتصاد الوطني، فخصّه بقوانين تكفل تنظيم القطاع، وفي المقابل تبنى المشرّع سياسة تشريعيّة قائمة على حماية البيئة في إطار التّنمية المستدامة، من خلال سنّ قوانين تضمن حماية ووقاية البيئة، بجميع عناصرها وتحقّق أهداف التّنمية المستدامة. لذلك يهدف البحث عرض مختلف مراحل تطوّر النّظام القانوني للمحروقات في الجزائر، وفي ذات الوقت مراعاة ما تتطلّبه مقتضيات حماية البيئة، وتوصّل البحث لنتائج أهمّها: ارتباط إدراج حماية البيئة في قانون المحروقات الجزائري بتطوّر السّياسة البيئيّة في الجزائر. Abstract: The Algerian legislator gave great importance to the hydrocarbon sector, due to its importance in the national economy. He assigned laws to ensure the organization of the sector .In turn, the legislator adopted a legislative policy based on environmental protection within the framework of sustainable development .This is by enacting laws that guarantee the protection of the environment, with all its components, and achieve the goals of sustainable development. Therefore, the study aims to present the various stages of the legal system for hydrocarbons in Algeria’s development, while at the same time taking into account the requirements of environmental protection. The studyreached a set of results, the most important of which is: protection in the Algerian hydrocarbons lawis linked with the development of environmental policy in Algeria.
