The Constitutional Dimension In The Competency Of The Urgent Administrative Judge

Abstract
This study aims at revealing the role of the urgent administrative justice in enshrining the constitutional bases in the light of its original tasks that include wide prerogatives to protect the basic rights and freedoms. Besides, the study sheds light on the contribution of the principle of supremacy of the constitution in their protection in front of the justice through the exception of constitutionality to strengthen the posteriori control on the law’s constitutionality as a secondary field. تهدف هذه الدراسة إلى الكشف عن دور القضاء الإداري الاستعجالي في تكريس القواعد الدستورية في إطار مهامه الأصلية، والتي يتمتع بمقتضاها بسلطات واسعة لحماية الحقوق و الحريات الأساسية. كما تسلط هذه الدراسة الضوء على مدى مساهمته في تكريس مبدأ سمو الدستور من خلال إجراء الإحالة بالدفع بعدم الدستورية كآلية مستحدثة لحماية الحقوق والحريات أمام القضاء تعزيزا للرقابة اللاحقة على دستورية القوانين كاختصاص فرعي.
