الاشراف القضائي على ضبط وإعداد القوائم الانتخابية

الملخص
من المؤكد أن الاقتراع يشكل اجراء أساسيا في العملية الانتخابية،إلا أنه يسبقه عدد كبير من العمليات والإجراءات القانونية المعقدة وترتبط هذه العمليات والأفعال القانونية المختلفة بالضرورة بالانتخاب،ذلك أن تعدد الإجراءات القانونية هو الأساس لتبريرالاشراف القضائي الذي يجب أن ينظر في النزاعات الناتجة عن كل عملية. وتتمثل وظيفة القاضي في مراقبة وضبط هذه الأفعال في ضمان اطارتطبيق المبادئ والقوانين الانتخابية التي تحكمها،كما يعتمد القاضي على مبادئ الحرية الانتخابية لضمان ضبط عمليات إسناد صفات الناخب،وفي مقدمة هذه الاجراءات القانونية عملية ضبط وإعداد القوائم الانتخابية ومراجعتها. وعليه تعد عملية ضبط وإعداد القوائم الانتخابية مسألة بالغة الأهمية وهذا بالنظر الى ما تكتسيه هذه العملية من مكانة في تحديد مصير الانتخابات وتحديد شروط اكتساب صفة الناخب،كما أنها تهم كل الفاعلين السياسيين المشاركين في الانتخابات خاصة الناخبين والمرشحين،ومن هذا المنطلق تحرص معظم التشريعات الانتخابية على مراجعة هذه القوائم بصفة منتظمة ودورية تحت رقابة وإشراف القضاء . It is certain that voting constitutes a basic procedure in the electoral process, but it is preceded by a large number of complex legal processes and procedures. These different legal processes and actions are necessarily linked to the election, so that the multiplicity of legal procedures is the basis for justifying judicial supervision that must consider the disputes resulting from each process. The function of the judge is to monitor the control and control of these acts in ensuring the framework of the application of the electoral principles and laws that govern them. The judge also relies on the principles of electoral freedom to ensure control of the processes of attribution of the characteristics of the voter, and at the forefront of these legal procedures is the process of controlling and preparing the electoral lists. Accordingly, the process of controlling and preparing electoral lists is a very important issue, and this is given the status of this process in determining the fate of the elections and determining the conditions for acquiring the voter status. It is also of concern to all political actors participating in the elections, especially voters and candidates, and from this point of view most electoral legislation is keen on Review these lists regularly and periodically under the supervision and supervision of the judiciary.
