الملخص

الملخص: يؤدي مبدأ الفصل بين جهتي المتابعة والتحقيق دورا هاما في مجال الإجراءات الجزائية، من حيث أنّه يدعم قرينة براءة المتهم، والذي يظهر من خلال حماية حيادية جهة التحقيق والناتجة عن كونها جهة مغايرة لجهة المتابعة لهذه القرينة عند جمع الأدلة والمساس بالحرية الشخصية، كما تساهم القواعد المنظمة لعمل جهة التحقيق والمتمثلة في كل من قابلية قاضي التحقيق للتنحية والرد، وإلزامية التحقيق في الجنايات على درجتين في كفالة هذه القرينة، وأخيرا يتأكد تعزيز هذا المبدأ لقرينة البراءة من خلال منح الدول المعتنقة للجمع بين جهتي المتابعة والتحقيق صلاحية المساس بالحرية الشخصية لجهة غير جهة المتابعة. :Abstract The principle of separation between the accusation and the investigation has a very important place in penal procedure, because it protects the presumption of innocence, which is sawing through the impartiality of the institution of investigation when it looks for evidence, and restricts the individual liberties, and the participation of the rules governing the work of the investigation party which is represented with investigation judge recusal and the obligation to investigate felony in two degrees in ensuring the accused presumption innocence, finally the protection of the presumption of innocence is confirmed by this principle because even the countries which give investigation and accusation to the public prosecution give the authority of imprisonment to a judge other than the prosecutor.
