العمل عن بعد Teleworking

الملخص
غاية هذا العمل هي استطلاع واقع وأهمية العمل عن بعد، خاصة في ظل الأزمات الطارئة، وقد سعينا إلى ذلك من خلال مقدمة ومبحثين، وفق المنهج الوصفي التحليلي، والمنهج القانوني المقارن، حيث تحدث المبحث الأول عن ماهية العمل عن بعد ببيان مفهومه وتقصي لدوره وتحديد لألوانه، وقد برز لدينا أن عقد العمل "عن بعد" يرتبط - بشكل جوهري- بالتقنيات الحديثة وما وفرته من وسائل اتصال أتاحت الفرصة للعامل أن ينفذ التزاماته العقدية من مكان يقع خارج مقر العمل المعتاد، فيما تحدث المبحث الثاني عن آثار العمل عن بعد بتسليط الضوء على أهم ما أعتبر من محاسنه وأهم مساويه، وقد بيَّن البحث علاقة العمل عن بعد مع التكنولوجيا الرقمية من جهة وعلاقته مع الحياة الخاصة من جهة أخرى، إضافة إلى أن البحث تناول حالات التأمين عن حوادث العمل التي قد تحدث بسبب أو بمناسبة العمل عن بعد. The purpose of this work is to explore the reality and importance of remote work, especially in light of emergency crises, and we sought to do this through an introduction and two sections, according to the descriptive analytical approach and the comparative legal approach, where the first section talked about the nature of Teleworking by explaining its concept, investigating its role, and defining its colors. It has become apparent to us that the “remote” work contract is linked - fundamentally - to modern technologies and the means of communication they provide, which have provided the opportunity for the worker to carry out his contractual obligations from a place located outside the usual workplace, While the second section talked about the effects of Teleworking by highlighting what was considered its most important advantages and disadvantages. The research showed the relationship of Teleworking with digital technology on the one hand and its relationship with private life on the other hand, in addition to that the research dealt with cases of insurance for work accidents. Which may occur due to or on the occasion of Teleworking
