القرار الإداري الإلكتروني : قراءة في المفهوم و الأهمية

الملخص
يعد موضوع القرار الإداري الإلكتروني من المواضيع ذات الأهمية البالغة؛ لما له من أثر مباشر على حياة المواطن وعلاقته بالإدارة و على التسيير الحسن للمرفق العام ؛وتسعى الجزائر جاهدة لتعميم الإدارة الإلكترونية على جميع الإدارات والمؤسسات ذات الطابع الإداري على مستوى التراب الوطني، ويعد القرار الإداري أهم وسيلة قانونية تعبر بها االإدارة عن إرادتها، لاسيما مع التطور التكنولوجي الذي تشهده وسائل الإعلام والاتصال و التوجه نحو تعميم الإدارة الإلكترونية لتقريب الإدارة من المواطن. وتهدف الدراسة إلى تحديد مفهوم القرار الإداري ووالتأكيد على الأهمية ، و توصلت الدراسة إلى أن القرار الإداري الإلكتروني لايختلف كثيرا على القرار الإداري التقليدي سوى في صدروه بطريقة إلكترونية وله نفس أركان القرار التقليدي، ويعد نقطة تحول في مسار تطور القانون الإداري المعاصر The subject of the electronic administrative decision is one of the topics of great importance, because it has a direct impact on the life of the citizen and hisThe issue of electronic administrative decision is considered one of the most important topics. Because of its direct impact on the life of the citizen and his relationship with the administration and on the good management of public facilities, Algeria is striving to spread electronic administration to all departments and institutions of an administrative nature at the level of the national territory. The administrative decision is the most important legal means by which the administration expresses its will, especially with the development The technological trend witnessed by the media and communication and the trend towards generalizing electronic administration to bring the administration closer to the citizen. The study aims to define the concept of the administrative decision and to emphasize its importance. The study concluded that the electronic administrative decision does not differ much from the traditional administrative decision except in that it was issued electronically and has the same elements as the traditional decision, and it is considered a turning point in the path of development of contemporary administrative law.
