الحماية القانونية لبطاقات الدفع الإلكتروني -الواقع والتحديات-

الملخص
الملخص: تعتبر بطاقات الدفع الإلكتروني أهم وسائل الدفع الحديثة وأكثرها انتشارا على مستوى العالم لما تقدمه من امتيازات ومزايا للمتعاملين بها، غير أنها لزالت تطرح جملة من الإشكالات القانونية يأتي في مقدمتها مسألة الحماية التي جعلت كثير من المتعاملين يتخوفون من التعامل بها خاصة في المعاملات الدولية لأن الاعتداءات والجرائم الواقعة عليها يزداد يوما بعد يوم، الأمر الذي يجعلنا نتساءل عن الضمانات التشريعية المقررة لحماياتها وهل هي كافية أم أننا بحاجة إلى قانون خاص يوفر لها الحماية المرجوة؟ وقد حاولت هذه الورقة البحثية الإجابة عن هذا الإشكال وما يندرج تحته من تساؤلات فرعية وتوصلت إلى أنه وعلى الرغم من الجهود التشريعية المبذولة على الصعيدين الداخلي والدولي لحماية بطاقات الدفع الإلكتروني وتعزيز ثقة المتعاملين فيها إلا أنها لم تحقق لها الحماية اللازمة وعليه فإنه بات من الضروري إصدار نصوص تشريعية خاصة حبذا لو كانت موحدة على مستوى العامل ذلك أن التعامل بهذه البطاقات لا يقتصر على المعاملات الداخلية بل إنه في الغالب يكتسي الصبغة الدولية. Abstract : Electronic payment cars are considred the most important modern means of payment because of the privileges and advantages they provide to their customers . However, it still raises a number of legal problems, the Most important of which is the issue of protection, which has made many dealers afraid of dealing with it, especially in international transactions, because the attacks and crimes committed against it are increasing day after day which makes us wonder what the legislative guarantees are established to protect it, and whether they are sufficient or not. Do we need a special law that provides the desired protection? This research paper attempted to answer these issues and the sub-questions that fall under them, and concluded that despite the legislative efforts made at the internal and international levels to protect electronic payment cards and enhance customers confidence in them, they did not achieve the necessary to issue texts. Special legislation, preferably if it were unified worldwide, since dealing with these cad sis mostly international.
