الملخص

الملخص: يركز هذا البحث على أحد المبادئ التي يقوم عليها التشريع الجنائي، وهو "مبدأ شخصية العقوبة الجنائية" ،حيث تناول الإطار المفاهيمي لهذا المبدأ في الشريعة والقانون وتطوره التاريخي في الأنظمة الوضعية، وتأصيله في ضوء النصوص الشرعية والقواعد الفقهية والنصوص القانونية، وذكر بعض تطبيقاته الشرعية والقانونية وخاصة القانون الجزائري مع الإشارة إلى الحالات الاستثنائية وعلاقته بالمسؤولية الجنائية وتفريد العقوبة، ومن أهم النتائج المتوصل إليها هي أن مبدأ شخصية العقوبة الجنائية هو مبدأ أصيل في التشريع الجنائي الإسلامي، على عكس القوانين الوضعية التي اعترفت به حديثًا كمبدأ عام، إلا أنها خالفته في العديد من القوانين الجزئية الخاصة، والهدف منه في الواقع العملي هو بيان أثره في تحقيق العدالة الجنائية، والتي تقتضي أن يكون كل شخص مسؤولًا عن أفعاله وأن تكون العقوبة شخصيًة، ولا تتم معاقبة أي شخص آخر بدلا منه. Abstract: This research focuses on one of the principles on which criminal legislation is based, which is the "principle of personal criminal punishment". The conceptual framework of this principle in Islamic legislation and law, its historical development in positive systems, and its grounding in the light of legal texts, jurisprudential rules, and legal texts were discussed. Some of its legislative and loyal practices especially Algerian law, were mentioned, with reference to exceptional cases and its relationship to criminal responsibility and the uniqueness of punishment. One of the most important results reached is that the principle of personal criminal punishment is an authentic principle in Islamic criminal legislation, unlike positive laws that have recently recognized it as a general principle, but have violated it in many special laws. The practical goal of this principle is to demonstrate its impact on achieving criminal justice, which requires that every person be responsible for their actions and that punishment be personal.
