المحافظة على جمالية المدن في التشريع الجزائري

الملخص
ملخص: تعتبر المحافظة على جمالية المدن أمرا مستحدثا في القانون الإداري، وذلك باعتبارها أحد عناصر النظام العام بمفهومه الحديث بعدما تغيرت وظيفة الدولة في الوقت الحالي لاسيما عند ممارستها لوظيفة الضبط الإداري في المجال العمراني حيث اتسعت في مجال تدخلها في جميع مناحي الحياة. وهذا ما كرسه المشرع الجزائري في منظومته القانونية على غرار باقي مشرعي دول العالم، وهذا بغية المحافظة على جمالية المدينة أو جمال المدن وروائها، نتيجة لما آلت إليه مدننا من فوضى عمرانية وتلوث بيئي، إضافة إلى فقدانها لجماليتها ومنه أصبح من الضروري المحافظة على جمالية مدننا لتحسين صورتها وطنيا ودوليا. Abstract: Preserving the aesthetics of cities is considered an innovation in administrative law, as it is one of the elements of public order in its modern sense, after the state’s function has changed at the present time, especially when it exercises the function of administrative control in the urban field, as it expanded in its field of intervention in all aspects of life. This is what the Algerian legislator has enshrined in his legal system, similar to the rest of the world’s legislators, and this is in order to preserve the aesthetics of the city or the beauty of cities and their waters, as a result of the urban chaos and environmental pollution that our cities have become, in addition to their loss of their aesthetics, and from it it has become necessary to preserve the aesthetics of our cities to improve Its image is national and international.
