النطاق الجزائي لجنحة العالم بأسرار الشركة في قانون البورصة الجزائري

الملخص
البورصة هي سوق لتبادل البائع والمشتري للأوراق المالية،حيث يتم التبادل بعد الإتفاق على سعر لهذه الأوراق وتطرح الشركات أسهمها في السوق كوسيلة لجمع رؤوس أموال لبداية أو للتوسع في مشروعاتها ،فهي سوق مالية ذات طبيعة خاصة فهي كالسوق في أن كلا منها فيه بيع وشراء وأخذ وعطاء ،إلا أن البورصة تتميز عن السوق بكونها سوقا منظمة تحكمها لوائح وقوانين وأعراف وتقاليد. ولحماية المتعاملين في البورصة قام المشرع الجزائري بوضع قواعد وقوانين مختلفة ،الجنائية منها حيث حصر صور التجريم في مجال القيم المنقولة في ثلاث جرائم وأهمها "جنحة العالم بأسرار الشركة" The stock market is a market for the exchange of the seller and the buyer stock exchange after the agreement on the price of those securities and the companies put up their shares in the market as a means to raise capital to start or expand their projects,the financial market is of a special nature is such as to both the selling and buying and giving ,but that the stock market is the market as a market of the organization governed by the regulation and the laws and costoms and traditions. And to protect the dealers on the stock exchange,the algerian legislature to develope different rules and laws,criminal,where an inventory of photos of the criminalization of the values transferred (stock) in three crimes,the moste important of which is the misdemeanor of the knower of secrets company.
