النظرية العامة للقرار الإداري في ظل المستجدات الإلكترونية

الملخص
تهدف هذه الورقة البحثية إلى معالجة الآثار المترتبة عن تطبيق تكنولوجيات الإعلام والاتصال الحديثة على النظرية العامة للقرار الإداري، وقد تم التوصل إلى ظهور ما يعرف بالقرار الإداري الالكتروني الذي يختلف من حيث مفهومه وأركانه ووسائل نفاذه عن القرار الإداري بمفهومه التقليدي، إلا أنه وبالرغم من إيجابيات العمل بنظام الرقمنة في مجال القرار الإداري سيما على تحسين الخدمة العمومية وترقية علاقة الإدارة بالمواطن، إلا أن غياب النصوص القانونية والتنظيمية التي تنظم أساليب العمل بهذا النمط الجديد، شكل عائقا أمام انتقال القرار الإداري التقليدي إلى العالم الرقمي. This research paper aims to address the effects resulting from the application of modern information and communication technologies on the general theory of administrative decision-making. The emergence of what is known as electronic administrative decision, differing in its concept, components, and accessibility means from traditional administrative decisions, has been identified. Despite the positive aspects of digitization in the realm of administrative decisions, particularly in improving public service and enhancing the administration's relationship with citizens, the absence of legal and regulatory texts governing the methods of operation in this new paradigm has posed a barrier to the transition of traditional administrative decisions to the digital world.
