الملخص

إن انتهاج اقتصاد السوق ، فرض على الجزائر ، وعلى غرار العديد من الدول ، الاعتراف بالحريات الاقتصادية ،أهمها حرية التجارة والصناعة وحرية الاستثمار . إلا أن هذه الحريات لا يمكن ممارستها بصفة مطلقة وإلا فسوف تمارس مخالفة للإطار الذي وضعت لأجله وتكيف باعتبارها تعديا. والأمر ذاته بخصوص حرية ممارسة الأسعار، باعتبارها حرية اقتصادية، حيث أن الغرض الرئيسي من وراءها هو استقطاب الاستثمار الأجنبي. إلا أن ممارسة الأسعار وفي حالة عدم ضبط المعالم الخاصة بها، عن طريق وضع الاطار العام والحدود التي لا يمكن تخطيها يمكنها أن تتخذ صورة التعدي. والمتمثلة أساسا في «إغراق المنتوج الوطني». إلا أن النصوص التشريعية –الدولية والوطنية- تتضمن مقتضيات تهدف أساسا إلى حماية المنتوج الوطني من الإغراق. وذلك عن طريق اتخاذ إجراءات معينة، وتدابير مكافحة الإغراق والمتمثلة في تدابير الدفاع التجارية. Abstract: (200 Words) (Commercial dumping between verification and investigation) Adopting a market economy has imposed on Algeria, like many countries, the recognition of economic freedoms, the most important of which are freedom of trade and industry and freedom of investment. However, these freedoms cannot be exercised absolutely, otherwise they will be exercised in violation of the framework for which they were established and deemed an infringement. The same applies to the freedom to exercise prices, as it is an economic freedom, as the main purpose behind it is to attract foreign investment. However, the practice of prices, in the event that their parameters are not controlled, by setting the general framework and limits that cannot be crossed, can take the form of infringement. Which basically represents “dumping the national product.” However, the legislative texts - international and national - include provisions aimed primarily at protecting the national product from dumping. This is done by taking certain measures, anti-dumping measures, represented by trade defense measures. .
