الملخص
تقدّم الورقة البحثية محاولة لمعالجة معضلة تحديد معايير تقييد الحق في التعبير الحرّ، ومدى إمكانية وضع محددات عالمية تتعلق بتدخل سلطة الدولة في مجال ممارسات التعبير الحرّ، وذلك من خلال اعتماد المنهج التحليلي الموافق للدراسات القانونية، حيث تمّ تقديم دراسة تحليلية لجُملة من الاجتهادات الفقهية والنصوص القانونية ذات الصلة، وإبراز أوجه الاتفاق والاختلاف بينها، حيث خلُص البحث إلى كون مجال التعبير الحر مُتغير تابع للعديد من الظواهر وأن القيود المفروضة عليه تتسم بالانتقائية وعدم الوضوح. The research paper presents an attempt to address the dilemma of determining the criteria for restricting the right to free expression, and the extent to which it is possible to set global determinants related to the interference of the state authority in the field of free expression practices, through the adoption of the analytical approach corresponding to legal studies, where an analytical study of a number of jurisprudence and related legal texts was presented, and highlighted the areas of agreement and differences between them, as the research concluded that the field of free expression is variable and dependent on many phenomena and that the restrictions imposed on it are selective and unclear.
