الملخص
إن التشريعات المعاصرة أولت عناية بالغة لمسألة إصلاح المحبوسين وإعادة إدماجهم في المجتمع، وما من شك أن الأحكام القانونية التي وردت في قانون تنظيم السجون وإعادة الادماج الاجتماعي للمحبوسين تشكل عصارة ما توصلت إليه القوانين والأـنظمة القانونية المقارنة في المعاملة العقابية الحديثة، لاسيما من حيث تكريسه لمبادئ حركة الدفاع الاجتماعي الحديثة التي أخذت بمبدأ حماية المجتمع عن طريق إعادة تأهيل المجرم إجتماعيا. لذلك تشكل مسألة إعادة إدماج الطفل الجانح، إحدى الاهتمامات الجوهرية للسلطة العامة في الجزائر، تأسيسا لما استقر عليه الموقف الدولي بشأن توفير حماية للأطفال ومرافقتهم سواء في الظروف العادية أو في حالة تعرضهم للجنوح، وهو الأمر الذي يتطلب الوقوف على مختلف الآليات التي يمكن أن تحقق التكيف الاجتماعي والتربوي للطفل، والتي تعتبر الخطوة الأولى في تأهيل الطفل الجانح وتحضيره إلى ما بعد الإفراج، لإعادة إدماجه في المجتمع من جديد. Abstract: Contemporary legislation has paid particular attention to the question of the rehabilitation and reintegration of prisoners into society, there is no doubt that the secondary provisions of the prison regulation and social reintegration act for prisoners constitute the epitomize of comparable laws and regulations in modern penal treatment, particularly in respect of its dedication to the principles of the modern social defense movement, which Introduced the principle of social protection through the social rehabilitation of the criminal. Therefore, the question of the integration of a child offender is one of the fundamental concerns of the public authority in Algeria, as established by the international position on the protection and facilities of children, whether in normal circumstances or the event of delinquency, This requires the identification of various mechanisms that can achieve the child's social and educational adjustment, which is the first step in the rehabilitation and preparation of the delinquent child until after release, to reintegrate it into society.
