الملخص
تهدف هذه الدراسة إلى البحث في موضوع النظام والسلوك البرلماني، إذ إن البرلمان مستودع الحرية والشرعية لغايات تكوين برلمان وطني هدفه تحقيق مصلحة واحدة عامة، دون تحيزات مصلحية شخصية وجهوية، بما يرتقي بسمعة البرلمان. وتكمن إشكالية البحث في الإجابة عن تساؤلات الدراسة الخاصة بالسلوك البرلماني لمعالجة قصور الجانب التشريعي في تنظيم المبادئ والمعايير البرلمانية، وتضارب المصالح، والتصريح عن الأصول، ومناقشة اللغة البرلمانية في نظام الكلام والجلسات البرلمانية وعلى ضوء ذلك، مناقشة الإخلال بالسلوك البرلماني بمسؤوليتها المتعددة تأديبيا ومدنيا وجزائيا، وبحث إشكالية تقدير الجزاء الذي يقع على الامتياز البرلماني. وتوصل الباحث في هذه الدراسة إلى عدد من النتائج والتوصيات، ومنها: إجراء مراجعة لمدونة السلوك والسلطة التنظيمية للجنة النظام والسلوك، والارتقاء بثقافة المدونة وتنفيذها بتحقيق العدالة الإجرائية، والاعتراف الدستوري بالمعارضة البرلمانية. The aim of this study is to examine the issue of parliamentary system and conduct. Parliament is the repository of freedom and legitimacy for the purpose of forming a national parliament whose aim is to achieve a common public interest without prejudice to personal and provincial interests something which elevates the reputation of Parliament. The issue which this study is to answer the questions of the study concerning the parliamentary conducts in order to address the parliamentary principles and standards as well as the interest conflicts in all their contradictory manifestations, registery of interests ,declaration of assets and expeneses, allowances and Discuss parliamentary language in the system of speech and parliamentary sessions in the light of this the current study is to Discuss the misconduct of parliamentary responsibilities such as; disciplinary, civil and criminal responsibility. And discuss the problem of estimating the penalties of the parliamentary privilege. In this study, the researcher reached a number of conclusions and recommendations related to conducting a review of the Code of Conduct and the organizational authority of the “ethics Committee”; they are also related to upgrading the culture of the Code and implementing it by achieving procedural justice and constitutional recognition of the opposition.
