تطبيق النص الجزائي من حيث المكان على الشركات العابرة للحدود

الملخص
تعد الشركات التجارية من أهم الكيانات القانونية كونها تساهم في بناء الاقتصاد الوطني لأي دولة، و قد يمتد نشاطها عن طريق الإستثمار خارج إقليم الدولة الواحدة، فتأسس الشركة الأم في دولة ما وتتخذ مقرها فيها أو خارجها، و يتفرع عنها عدة شركات وليدة، أو تتحالف فيما بينها فيطلق عليها الشركات العابرة للحدود،غير أن هذه الأخيرة قد تنشط في إطار القانون كما قد تنشط في إطار غير قانوني فتدخل تلك الأفعال في دائرة التجريم. و نظرا للخطورة الإجرامية لتلك الشركات عكفت الدول على تضمين تشريعاتها مبادئ قانونية تضبط كيفية سريان النص الجزائي عليها من حيث المكان عند ارتكابها للجريمة و من بينها التشريع الجزائري. الكلمات المفتاحية: شركات - عابرة – حدود –جنسية- نص- جزائي- مكان Abstract: Commercial companies are among the most important legal entities as they contribute to building the national economy of any country, and their activity may extend through investment outside the territory of one country, so the parent company is established in a country and takes .its headquarters in or outside it, and several nascent companies branch out from it or allied with each other They are called cross-border companies, but the latter may be active within the framework of the law and may also be active in an .illegal framework, so these actions are included in the criminalization circle. In view of the criminal seriousness of these companies, countries have endeavored to include in their legislation legal principles that control how the penal text applies to them in terms of the place when they commit the crime, including the Algerian legislation.
