حماية الأصول غير المادية بين استراتيجيات التغطية بالبراءات و إجراءات تريبس التحكيمية

الملخص
هدفت الدراسة لتوضيح تطور سبل حماية الأصول غير الملموسة التي ما فتئت نسبتها إلى مجمل الأصول تتزايد داخل ميزانيات المؤسسات وحتى الدول بدخول الرأسمالية مرحلة الاقتصاد القائم على المعرفة، نظرا لحساسية تنافسيتهما لهذه القيم المعنوية كالرأسمال البشري وبرامج الذكاء الاصطناعي والابتكار التنظيمي، الأمر الذي جعل المنافسة تتأجج حتى انفلتت عن القيود الأخلاقية فظهر التقليد والسطو على البيانات وسرقة المعلومات السرية. ما حمل جميع الفاعلين الاقتصاديين على السعي لتوفير حماية للذمة اللامادية سواء عبر التغطية بالبراءات أو بالاحتماء تحت اتفاقيات فض النزاعات المرتبطة بالملكية الفكرية. وقد استعملنا المنهج التحليلي استنتاجا واستنباطا ومقارنة لمناقشة تطور أساليب المنافسة وتقنيات الحماية المقابلة لها في ظل التحولات الجارية. The study aimed to clarify the development of ways to protect intangible assets, whose proportion to the total assets has been increasing within the budgets of institutions and even countries with the entry of capitalism into the stage of a knowledge-based economy. In view of the sensitivity of their competitiveness to these intangible values such as human capital, artificial intelligence programs and organizational innovation, which made the competition inflamed until it escaped from ethical restrictions, so counterfeit, data theft and theft of confidential information appeared. This prompted all economic actors to strive to provide protection for their immaterial integrity, whether through patent coverage or under intellectual property dispute resolution agreements. We have used the analytical approach to discuss the development of competition methods and corresponding protection techniques in light of the current transformations.
