الملخص
الملخص: تناقش هذه الدراسة -الموسومة ب " المسؤولية الجزائية للبرلماني: دراسة مقارنة"- مسؤولية البرلماني وأثرها على ولايته البرلمانية، في مطلبين، هما: المطلب الأول فيناقش جدلية الحكم القضائي الجزائي ضد البرلماني، والثاني يتدارس ظاهراتية خرق الحصانة البرلمانية: الإكراهات والإصلاحات.ووظفت الدراسة منهجا تأويلا ظاهراتيا لمعالجة المحددات والموجهات لموضوع الدراسة، استحداثا لمناهج حديثة في الحقل الدستوري، الذي يعاني أزمة منهجية، وتوصلت الدراسة إلى عدد من النتائج منها هشاشة الحصانة البرلمانية، وأوصت بضرورة تكريس ضمانات قانونية وقضائية لمعالجة هذه الهشاشة. الكلمات المفتاحية: هشاشة الحصانة البرلمانية، المسؤولية الجزائية البرلمانية. Abstract: This study, tagged "Penal Responsibility of Parliamentarians: A Comparative Study" - discusses the responsibility of parliamentarians and their impact on their parliamentary mandate, in two demands: the first, discusses the argument of the penal judgement against parliamentarians, and the second, examines the prima facie violation of parliamentary immunity: coercions and reforms. The study used a prima facie interpretation approach to address the determinants and orientations of the study's topic, introducing modern approaches in the constitutional field, which is experiencing a systemic crisis, and found a number of findings, including the fragility of parliamentary immunity, and recommended that legal and judicial safeguards be established to address this vulnerability.
