الملخص
الملخص: من ضمن الأراضي الخاصة للدولة نجد الأراضي الفلاحية التي كانت و مازالت إحدى الركائز الأساسية في تنمية الاقتصاد الوطني و التي تعتبر بديلا أساسيا للمحروقات و ذلك من خلال عدة قوانين منها القانون 87/19 المؤرخ في 08 ديسمبر 1987 و الذي تم إلغاؤه بموجب القانون 10/03 المؤرخ 15 أوت 2010 الذي يحدد شروط و كيفية استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة و المرسوم التنفيذي رقم 10-326 المؤرخ في 23 ديسمبر 2010 الذي ينص على كيفية تنفيذ حق الامتياز لاستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة. حيث نص القانون 10/03 في المادة 21 على عقد الشراكة الفلاحي الذي يتم إبرامه بموجب اتفاق بين المستثمر صاحب الإمتياز و المستثمر الشريك عن طريق عقد رسمي يحرره الموثق و يتم اشهاره بالمحافظة العقارية دون تبيان طبيعته القانونية و الذي اصطدم فيه الموثقون بعدم شهره و هو ما جعل المستثمرين الشركاء يلجؤون للقضاء لإلزام المحافظين العقاريين بشهر عقود الشراكة. Abstract : Among the private lands of the state, we find agricultural lands, which were and still are one of the main pillars in the development of the national economy, and which are considered a basic alternative to hydrocarbons, through several laws, including Law 19/87 of December 08, 1987, which were abolished by Law 03/10 of August 15, 2010, which defines the conditions and how to exploit agricultural lands belonging to the private property of the state, and Executive Decree No: 10-326 of December 23, 2010, which stipulates On how to implement the right of concession to exploit the agricultural lands belonging to the private property of the state. Where Law 03/10 article 21, on the agricultural partnership contract, which is concluded according to an agreement between the concessionaire investor and the partner investor through an official contract drawn up by the notary and publicized in the real estate governorate without indicating its legal nature, in which the notaries collided with the lack of The possibility of publicizing it, which made the partner investors resort to the judiciary to oblige the real estate governors to publish the partnership contracts.
