الملخص
يعتبر التنزيل المقرر بمقتضى المواد (169-172) من قانون الأسرة نظاما خاصا لتجاوز وضعية الحرمان التي كان يعيشها الأحفاد الذين توفي أصلهم المباشر (الأب أو الأم) قبل جدهم أو جدتهم، إلا أن هذا النظام اعترضت تطبيقه عوائق أهمها صعوبة التأكّد من توافر الشروط التي وضعها المشرع لاستحقاق التنزيل للأحفاد، وحاجة الموثق لحكم قضائي، وهو ما أوجد حالة من تضارب الفرائض المحررة من الموثقين لنفس المتوفّى. El-Tanzil prescribed under articles 169-172 of the Family Code is considered a special system to overcome the situation of deprivation experienced by grandchildren whose immediate ascendants (father or mother) died before their grandfather or grandmother, but this system has been hampered by obstacles, the most important of which is the difficulty of ascertaining the fulfillment of the conditions set by the legislator for entitlement to download for grandchildren, and the need for a notary to obtain a judicial ruling, which has created a situation of conflict between the obligations issued by notaries for the same deceased
