Challenges Confronting Local Authorities In Providing Public Services

Abstract
Despite the allocation of authorities and powers to local authorities by the Algerian legislator, they touch and affect all aspects of the local citizen's life. However, the success of these authorities in fulfilling their assigned tasks largely depends on their ability to access financial resources that can enable them to provide high-quality services to citizens, especially those in underdeveloped areas. This should be accompanied by granting citizens the freedom to exercise democracy by electing representatives to local elected councils. By examining the financial resources of local authorities, we find that despite the legal framework set by the Algerian legislator for local authorities' finances through a financial document called the "Local Authorities Budget," these authorities face several challenges. These challenges primarily involve government interference in its preparation and distribution, either directly or through non-concentrated bodies empowered to manage local administration. Consequently, this leads to financial deficits significantly impacting the development and implementation of local development projects. On a legal level, local administration suffers from a weak level of local election representation from a political perspective, and administrative corruption and bureaucracy have emerged as notable issues. These factors have greatly contributed to their inability to perform their intended tasks of providing citizens with the best services for a prosperous and happy life. رغم ما منحه المشرع الجزائري للجماعات المحلية من اختصاصات وصلاحيات، تطال وتمس جميع المجالات الحياتية للمواطن المحلي، إلاّ أن نجاح هذه الأخيرة في تغطية المهام الموكولة إليها، سيبقى مُتوقف إلى حد كبير على مدى امتلاكها لمصادر تمويلية تستطيع من خلالها توفير أجود الخدمات للمواطنين خاصة الذين ينتمون للمناطق محدودة التنمية، وترك الحرية للمواطنين من أجل ممارسة الديمقراطية عن طريق إنتخاب من يمثلهم في المجالس المحلية المنتخبة، فبالرجوع إلى المصادر التمويلية للجماعات المحلية، نجد أن المشرع الجزائري بالرغم من أنّهُ أطر مالية الجماعات المحلية قانونيا؛ وذلك عن طريق وثيقة مالية تُدعى في صلب القانون "ميزانية الجماعات المحلية "، إلا أنّ هذه الأخيرة تُواجه العديد من التحديات تتمثل أساسا في تدخل الحُكومة في إعدادها وتوزيعها سواء بطريقة مباشرة، أو عن طريق هيئات عدم التركيز التي خُول لها صلاحية بسط يدها على تسيير الإدارة المحلية، مما يؤدي بالضرورة إلى وقوعها في عجز مالي أثر بشكل ملحوظ على إعداد وتجسيد المشاريع التنموية المحلية، أما من الناحية القانونية فالإدارة المحلية تعاني من ضعف مستوى المنتخب المحلي من الناحية السياسية، وبروز ظاهرة الفساد الإداري والبيروقراطية من الناحية الإدارية. مما أدى بها بشكل كبير وجلي إلى عجزها عن تأدية مهامها التي وُجدت من أجل تلبيتها وهي توفير للمواطن أجود الخدمات لعيشه برفاهية وهناء.
