قانون حماية المخطوطات في الجزائر بين التفعيل والتجديد – مقترحات صياغة قانون جديد -

الملخص
تعالج هذه الورقة البحثية قانون حماية المخطوطات في الجزائر ومحاولة دراسة مدى تفعيله على أرض الواقع ، وتقديم ما تضمنته مواده ، من خلال التطرق للآليات والصيغ التي حددها المشرع بنص تشريعي واضح ، تسهر على تطبيقه مجموعة من الهيئات التي تملك قوة وشرعنة قانونية من أجل الحافظ على المخطوطات من الضياع . بالإضافة لتطرق إلى جملة من المقترحات لإعادة صياغة قانون منفصل لحماية المخطوط عن قانون حماية التراث الثقافي ، يواكب تطور الميكنة الرقمية الحاصلة في العالم محاكي التجارب الرائدة في ميدان حماية المخطوطات ، وفق خطة ممنهجة تمنح أحكام نافدة وحصانة تشريعية قانونية ، تحرم على أي شخص يتطاول على هذه المادة التراثية الثمينة سواء بالتعدي أو بالتحقيق الغير الرزين. كلمات مفتاحية:قانون 98-4.، التراث.، المخطوط.، التراث الثقافي.، حماية المخطوطات. Abstract: This research paper deals with the law on the protection of manuscripts in Algeria and tries to study the extent to which it is activated on the ground, and to present what is contained in its articles, by addressing the mechanisms and formulas defined by the legislator with a clear legislative text, which is supervised by a group of bodies that have legal power and legitimacy in order to preserve the manuscripts from loss. In addition to addressing a number of proposals to redraft a separate law for the protection of manuscripts from the Law on the Protection of Cultural Heritage, it keeps pace with the development of digital mechanization taking place in the world, simulating leading experiences in the field of manuscript protection, according to a systematic plan that grants effective provisions and legal legislative immunity, which is prohibited to anyone who infringes on this precious heritage material, whether by infringement or by non-sober investigation.
