Abstract

تهدف هذه الورقة البحثية إلى دراسة واقع مرعب تعيشه البشرية في الآونة الأخيرة؛ وهو ظاهرة استهداف الأعيان المدنية وتدميرها في النزاعات المسلحة، ولا شك أنّ في الاعتداء عليها اعتداء على المدنيين أنفسهم بل وتدمير للحضارة الإنسانية بكل معالمها، لذلك فإن مسألة حمايتها تعد من أهم القضايا التي ترتبط بحماية المدنيين وبتراثهم الثقافي والروحي. ونظرا لخطورة هذه المسألة فقد سعى المجتمع الدولي إلى إضفاء الحماية عليها من خلال اتفاقيات جنيف لعام 1949 وبروتوكوليها الإضافيين لعام 1977 اللذين نصا صراحة على حماية الأعيان المدنية التي لا غنى عنها لبقاء المدنيين وحظرا مهاجمتها والاعتداء عليها، وعدا ذلك انتهاكا جسيما للقانون الدولي الإنساني، و قد يرقى إلى مستوى جريمة حرب. This research paper aims to study the terrifying reality that humanity has experienced in recent times. It is the phenomenon of targeting and destroying civilian objects in armed conflicts, and there is no doubt that attacking them is an attack on civilians themselves and even destroys human civilization with all its features. Therefore, the issue of protecting them is one of the most important issues that are closely related to the preservation of civilians and their cultural and spiritual heritage, and given the seriousness of this The issue has been sought by the international community to confer protection on it through the Geneva Conventions of 1949 and its Additional Protocols of 1977, which explicitly stipulate the protection of civilian objects that are indispensable for the survival of civilians and the prohibition of attacking and assaulting them, otherwise it is a violation of international humanitarian law and may amount to a war crime.
