الملخص

تعتبر حـقـوق الـطـفـل جـزءا لا يتجزأ مـن حـقـوق الإنسان، لذلك عمـلـت كـل مـن الشريعة الإسلامية والقـانـون الـدولي على حمايتها، إلا أن الشريعة الإسلامية كانـت شـاملة في طرحهـا لـحـقـوق الـطـفـل على عكس القانون الدولي الذي أهمل بعض هذه الحقوق وأغفلها. لقد أعطى التشريع الإسلامي مرحلة الطفولـة منزلـة رفيعـة، بحيـث تعلقـت بهـا أحـكـام كثيرة،يطالب بهـا كـل مـن الـوالـدين وذوي القربى وكل المجتمع، وقـد تأكـد ذلـك كـلـه مـن خـلال آيـات القـرآنالكـريم وأحاديث النبي صلى الله عليـه وسـلم، التي تؤسـس لـكـل هـذا وتضـع لـه المعـالم الـبـارزة والقواعد التي يقاس عليها . وهـذا مـا أقرتـه الاتفاقية الدوليـة لـحـقـوق الطفـل (الصادرة عـن الأمـم المتحدة في نيويورك سـنة1990) وهـو لا يخـرج في كلياتـه ولا جزئياتـه عـمـا قـرره الإسلام للطفـل مـن حـقـوق (قـبـل أربعـة عشـرقرنا من الزمان). The rights of the child are an integral part of human rights, so both Islamic law and international law worked to protect them. However, Islamic law was comprehensive in presenting the rights of the child, in contrast to international law, which neglected and overlooked some of these rights. Islamic legislation has given childhood a high status, as many provisions are attached to it, which are demanded by both parents and relatives and the whole of society, and all of this has been confirmed through the verses of the Noble Qur’an and the hadiths of the Prophet, may God’s prayers and peace be upon him, which establish all of this and set the rules for which the goat is measured. on her . This is what was approved by the International Convention on the Rights of the Child (issued by the United Nations in New York in 1990), and it does not deviate, in its entirety or in its parts, from what Islam decided for the child in terms of rights (fourteen centuries ago).
