التَّأمين التَّكافلي وأثره في تطوير التَّمويل الإسلامي وتحقيق التَّنمية المحليَّة – القطاع الفلاحي أنموذجا –

الملخص
ملخص: يُعتبر التَّأمين التَّكافلي الصِّيغة الشَّرعيَّة البديلة لصيغ التَّأمين التجارية التقليديَّة والكلاسيكيَّة، وهو من الصِّيغ التَّأمينيَّة التي لقيت رواجا وانتشارا واسعا في مختلف البلدان الإسلاميَّة، وقد تمَّ اعتماد هذه الصِّيغة رسميا من قبل المشرِّع الجزائري ونشر ذلك في الجريدة الرَّسميَّة، وقد جاء هذا البحث بهدف تسليط الضَّوء على هذه الصِّيغة التَّأمينيَّة التعاونيَّة، ومدى تأثيرها على التَّمويل الإسلامي وتحقيق التَّنمية المحليَّة. حيث بيَّنت هذه الدِّراسة مفهوم التّأمين التَّكافلي، وكذا المبادئ والخصائص التي تقوم عليها هذه الصِّيغة، كما حرص البحث على بيان الحكم الشَّرعي لهذا التَّأمين وذكر أبرز المجامع الفقهيَّة والهيئات الشَّرعيَّة التي أفتت بجوازه، وقد خلص البحث إلى إظهار البعد التَّنموي والاستثماري للتَّأمين التَّكافلي، ومدى تأثيره في تطوير التَّمويل الإسلامي، وتحقيق التَّنمية في قطاع الفلاحة على وجه الخصوص. Abstract : Takaful insurance is considered an alternative legal form to commercial and classic insurance formulas, and it is one of the insurance formulas that has gained popularity and wide spread in various Islamic countries, and has been adopted version of the Algerian legislature party, may have been published in the official gazette, came this research in order to highlight on this cooperative insurance formula, and the extent of its impact on Islamic finance and local development. Where this study showed the concept of Takaful insurance, as well as the principles and characteristics that underlie this formula, as researcher keen on the statement of the legal judgment of this insurance, he mentioned the most Fiqh academy and Sharia boards that fatwa is permissible, has concluded research to show the development and investment dimension of Takaful insurance, and its impact in the development of the Islamic finance and agriculture sector in particular.
