الملخص

ملخص: يناقش هذا البحث قضية محورية تتمثل في استجلاء قواعد الإمام مالك في دراسة علم مختلف الحديث، من خلال نماذج من أحاديث رسول الله صلى الله عليه وسلم التي ظاهرها التعارض الواردة في كتابه الموطأ، وتكمن أهمية هذا البحث في كونه من البحوث التي تسلط الضوء على جهود عالم من علمائنا الأجلاء وإبراز مكانته العلمية في دراسة علم مختلف الحديث، انطلاقا من قواعد علمية وضوابط منهجية، موظفا موسوعته الفقهية والأصولية واللغوية في ذلك، وقد جاء محققا لنتائج علمية من أهمها: ذهب الإمام مالك إلى نفي الاختلاف الحقيقي بين نصوص الوحيين، أما التعارض الظاهر بينهما إنما تعارض فيما يظهر للمستدل، وقدم الإمام مالك مسلك الجمع عن المسالك الأخرى؛ النسخ أو الترجيح، وختم -رحمه الله – هذه المسالك بمسلك التخير بين الأخبار، في حالة التعادل بين الخبرين تعادلا لا نسخ فيهما ولا وجه لترجيح أحدهما على الآخر. Abstract: This research discusses a central issue represented in the elucidation of the rules of Imam Malik in the study of the science of various hadiths, through examples of the hadiths of the Messenger of God, may God bless him and grant him peace, which appear to contradict in his book Al-Muwatta. Among our distinguished scholars and highlighting his scientific position in the study of the various sciences of hadith, based on scientific rules and methodological controls, employing his encyclopedia of jurisprudence, fundamentalism and linguistics in this, and he came to achieve scientific results, the most important of which are: Imam Malik went on to deny the real difference between the texts of the two revelations. As for the apparent contradiction between them, it is a contradiction in what appears to the inferred, and Imam Malik presented the path of collection from other paths; Abrogation or weighting, and sealing - may God have mercy on him - these paths with the path of choice between the news, in the event of a tie between the two reports, there is no copying in them and there is no reason to prefer one over the other.
