الملخص: نروم في هذه الدراسة إلى محاولة تقديم صورة من صور الأسرة الأندلسية عصري ملوك الطوائف والمرابطين؛ من زاوية المرأة الاندلسية وقضية الطلاق التي أدت إلى انحلال بيتها وتفكيك أسرتها، بالاعتماد على نوازل الفقيه ابن الحاج التجيبي الاندلسي الذي كان شاهد عيان على الفترة المدروسة، وعُرف بفتواه كقاضي الجماعة بقرطبة أيام الأمير علي بن يوسف بن تاشفين. فمن خلال نوازل الطلاق التي رفعت الى الفقيه؛ نرمي إلى محاولة فهم عقلية المرأة الاندلسية والزواج كنوع من دراسة الذهنيات، ومنه فهم طبيعة البيت الاندلسي وكيف كان يستسلم لقضية الطلاق، وعليه تشخيص الأسباب بداية بالخصوصيات التي تعلقت بالمرأة الاندلسية؛ سواءً تعلق ذلك بالمعايير التي اعتمدتها كنوع من الشروط في الرجل واعتبرتها بمثابة "الكفاءة" لقبول عقدة النكاح، ومن ثم تتبع مسار الأسباب التي أدت إلى خسارتها زوجها، وعقلها، ونفسها، وهي تخوض تجربة زوجية مجبرة عليها من قبل وليها أو وصي عليها، فقضية الطلاق لم تكن ظاهرة سهلة بل انتشرت في المجتمع الاندلسي وهددت حياة المرأة وتعدت تداعيتها إلى أولادها. Abstract: In this study, we aim to present an image of the modern Andalusian family, the Taifa and Almoravid kings. From the angle of the Andalusian woman and the issue of divorce that led to the dissolution of her house and the dissolution of her family, relying on the calamities of the jurist Ibn al-Hajj al-Tajibi al-Andalusi, who was an eyewitness to the studied period, and was known for his fatwa as the congregational judge in Cordoba during the days of Prince Ali bin Yusuf bin Tashfin. It is through the cataclysms of divorce that were raised to our jurisprudence; We aim to try to understand the mentality of Andalusian women and marriage as a kind of study of mentalities, including understanding the nature of the Andalusian house and how it used to succumb to the issue of divorce. Through this, we tried in this article to diagnose the reasons, starting with the specifics that relate to Andalusian women; Whether it is related to the standards that he adopted as a kind of conditions in the man and considered them as “competence” to accept the marriage contract, and then trace the path of the reasons that led to the loss of her husband, her mind, and herself, while she is going through a marital experience forced upon her by her guardian or guardian, so the issue of divorce It was not an easy phenomenon, but it spread in Andalusian society and threatened the life of women and its repercussions extended to their children.
