حق المؤلّف الفنان في التتبّع

الملخص
ملخص: يجيز حق التتبّع للمؤلّف أو لورثته، خلال المدّة المحدّدة للحماية، المطالبة بنسبة تقدر بـ 5 بالمائة من ثمن إعادة بيع مصنّفه الأصلي للفن التشكيلي في المزاد العلني أو من طرف محترف المتاجرة بالفنون التشكيلية، وهو حق مالي غير قابل للتصرف فيه، ولا يثبت إلا لمؤلّفي الأعمال الفنيّة التشكيلية وبشكل متبادل فقط. ويهدف المشرع بإقراره لحق التتبّع في المادة 28 من الأمر 03-05 إلى تعويض المؤلّف أو ورثته بنسبة من عوائد استغلال مصنّفه الأصلي للفن التشكيلي أثناء تداوله بين المالكين المتتاليين بعد البيع الأوّل، على غرار حق المؤلّفين الآخرين كالموسيقيين والكتّاب في استغلال مصنفاتهم ماديا عن طريق حق الاستنساخ وحق التمثيل. ويتولى ممارسة حق المؤلّف في التتبّع، الديوان الوطني لحقوق المؤلف والحقوق المجاورة بعد إخطاره من طرف محافظ البيع بالمزاد الذي يلزم تحت مسؤوليته المدنية والجزائية بتحصيل المبلغ المستحق وتحويله إلى الحساب المصرفي للديوان الذي يقوم بتوزيعه على مستحقيه. Abstract : The tracking right allows the author or his heirs, within the prescribed period of protection, to claim for an estimated 5% from the resale price of the original work of plastic art at the public auction or by a professional plastic art trades which is an inalienable financial right, and can only be proved for the plastic artworks interchangeably. By approving the right of tracking in Article 28 of the Order 03-05; the legislator intends to compensate the author or his heirs for a proportion of the proceeds from the original work plastic art exploitation, while trading between successive owners after the first sale made by the author, similar to the right of other authors such as writers and musicians when they exploit their original works financially through the right of reproduction and the right of representation. This right is exercised by the National Office of Copyright and Neighboring Rights after being notified by the auctioneer who required to collect the outstanding amount – under his civil and criminal responsibility- and transfer it to the bank account of the Office , which distributes it to its beneficiaries.
