الأبعاد القانونية لتكريس مفهوم المباني الخضراء في ظل التشريع الجزائري

الملخص
تعالج هذه الورقة البحثية مختلف الجوانب المفاهيمية للمباني الخضراء وبعد تجاوب النصوص القانونية في الجزائر لهذا الطراز الجديد من البناء في سياق تحقيق الاقتصاد الأخضر، ضمن هدف أساسي هو ابراز فكرة تطبيق الاقتصاد الأخضر في الجزائر عبر عملية البناء الأخضر. اتضّح أن العمارة الخضراء تتميز بخصوصيات تميّزها عن العمارة التقليدية العادية منها: كفاءة الطاقة، كفاءة الموارد، حماية المناخ وحماية النظم الايكولوجية...وأن المشرّع الجزائري يطرح معالم التوّجه نحو المباني الخضراء بطريقة ضمنية، حيث تناولها في التشريعات الطاقوية أبرزها قانون التحكم في الطاقة رقم 99-09 ومرسوم تنفيذي رقم 2000-90، يتعلق بالأنظمة الحرارية في المباني الجديدة. وفي نصوص أخرى... ويعد القرار الوزاري المشترك المؤرخ في 29 مايو2022، يحدد دفتر الشروط النموذجي المتعلق بنمطية بناء المساجد، أول نص يتضمن صورة تطبيقية لنمطية بناء بمواصفات المبنى الأخضر. لكن غياب التنظيم القانوني الصريح لهذا الطراز من المباني وكذا غياب نظام تقييم الكفاءة وأسباب أخرى من شأنها أن تشكل عقبات في انجازها. كلمات مفتاحية: مبان خضراء، تنمية مستدامة، اقتصاد أخضر، كفاءة الطاقة، حماية المناخ. Abstract : This research paper deals the diffferent conceptualism aspects of green building and the response of Algeria legal system about the new model of building for achieving to the green economy, in order to present the most important objectives, through the application of the concept of the green economy in Algeria via a process of green buildings. It became clear that green architecture is characterized by characteristics that distinguish it from ordinary traditional architecture, including : Energy efficiency, resource efficiency, climate protection and ecosystem…and that the Algerian legislator presents the parameters of the trend towards green buildings in an implicit manner, Where it was dealt with in energy legislations, the most important is , law N°99-09 related to Energy control and Executive Decree N°2000-90 related to thermal systems in new buildings. And other textes…It consider a decision community ministerial dated 29th May. 2022, determine the specification sheets relative to standarization mosque building construction, the first text include application to standarization building with specification green construction. However, it is the absence of explicit legal regulation for this type of builging, the absence of an efficiency assessment system, and other reasons that would constitute obstacles in the matter of realizing it.
