الملخص
ملخص: يتناول هذا المقال مظاهر حماية الأسرة من جرائم ترك الأسرة: ترك مقر الأسرة، والتخلي عن الزوجة، والإهمال المعنوي للأولاد، وعدم تسديد نفقة محكوم بها قضاء، أي شكل من أشكال الإكراه أو التخويف الممارس من طرف الزوج ضد زوجته ليتصرف في ممتلكاتها أو في مواردها المالية. ولقد سعى المشرع الجزائري لحماية الأسرة، بدءا من وضع قواعد قانونية لتنظيم الأسرة، وصولا إلى تجريم الأفعال التي من شأنها المساس بالأسرة، ونظامها، والعقاب عليه، وقيد المتابعة الجزائية بشكوى الزوج المضرور في جريمتي ترك مقر الأسرة، والتخلي عن الزوجة، ونص على أن التنازل عن الشكوى يضع حد لهذه الإجراءات حفاظا على تماسك الأسرة كما نص على جواز إجراء الصفح في جرائم ترك الأسرة باستثناء الإهمال المعنوي للأولاد، وفي جريمة عدم تسديد نفقة محكوم بها قضاء يمكن الصفح بعد دفع المبالغ المستحقة للنفقة حماية للأولاد، ونص على إمكانية تطبيق إجراء الوساطة على جرائم ترك الأسرة. Abstract: This article deals with aspects of protecting the family from the crimes of leaving the family: leaving the family home, abandoning the wife, moral neglect of the children, non-payment of alimony adjudicated, any form of coercion or intimidation practiced by the husband against his wife to dispose of her property or her financial resources. The Algerian legislator sought to protect the family, starting with the establishment of legal rules for family planning, up to the criminalization of acts that would prejudice the family and its system, and punishment for it, and penal follow-up with the complaint of the injured husband in the two crimes of leaving the family headquarters and abandoning the wife, and stipulated that the waiver Regarding the complaint, it puts an end to these procedures in order to preserve the cohesion of the family, as it stipulates that forgiveness may be carried out in crimes of leaving the family, except for the moral neglect of the children, and in the crime of non-payment of alimony adjudged by a court, forgiveness can be made after paying the sums due for alimony to protect the children, and it stipulates the possibility of applying the mediation procedure to Crimes of leaving the family.
