نظام الوساطة في قانون الإستثمار الجزائري

الملخص
من بين الوسائل البديلة لحل منازعات الإستثمار، نظام الوساطة، وهي مرحلة متقدمة من التفاوض تتم بمشاركة الوسيط الذي يعمل على تسهيل الحوار بين الطرفين المتنازعين ومساعدتهما على التوصل لتسوية النزاع، فالوساطة آلية تقوم على أساس تدخل شخص ثالث محايد في المفاوضات بين الطرفين وتسهيل التواصل بينهما وبالتالي مساعدتهما على إيجاد تسوية مناسبة للنزاع، و التساؤل الذي يمكن طرحه يتمثل في مدى فاعلية و أخذ المشرع الجزائري بنظام الوساطة في قانون الإستثمار الجزائري؟ Among the alternative means of resolving investment disputes is the mediation system, which is an advanced stage of negotiation that takes place with the participation of the mediator who works to facilitate dialogue between the two conflicting parties and help them reach a settlement of the dispute. Mediation is a mechanism based on the intervention of a neutral third person in the negotiations between the two parties and facilitating communication between them and thus Helping them find an appropriate settlement to the dispute, and the question that can be asked is the extent of the effectiveness and adoption of the Algerian legislator's mediation system in the Algerian investment law?
