الملخص
توضح معظم الدراسات الفقهية بلا شك مسألة عدم الاستقرار المفاهيمي لخطاب الكراهية، وهذا بالنظر إلى عوامل متعددة تؤثر بشكل مباشر على الاصطلاح المتبنى تشريعيا أو قضائيا أو فقهيا، منها ما يرجع إلى الاختلاف القانوني، ومنا ما يعود لإرهاصات الإرث التاريخي، ومنها ما هو متعلق ببنية المجتمع، وغير ذلك من الأسباب التي صبت في وضع مفاهيم متضاربة، حيث ركزنا في هذه الورقة البحثية على المقاربة المفاهيمية المرتبطة بالإصطلاح الفقهي لخطاب الكراهية، وحاولنا الإجابة على تساؤل رئيسي يدور حول كيفية الوصول إلى تحقيق مبنى مفاهيمي سليم لخطاب الكراهية، وذلك من خلال الوقوف على الاختلافات الاصطلاحية بين المفهومين الضيق والموسع لخطاب الكراهية، ثم تحديد أهم المرتكزات التي ينبغي أن يبنى عليها تعريف خطاب الكراهية. And we tried to answer a key question about how to achieve a sound conceptual building for hate speech, By identifying the terminological differences between the narrow and expanding concepts of hate speech and then identify the most important pillars on which the definition of hate speech should be based.
