شروط الوفاء بالأوراق التجارية

الملخص

إن المعاملات الاقتصادية وتطورها في الآونة الأخيرة، والحاجة الماسة إلى إيجاد أدوات فعالة تعزز السرعة والائتمان بين المتعاملين الاقتصاديين أو التجار من أجل تسوية ديونهم، فوجدت الأوراق التجارية (السفتجة، والشيك) كأدوات الأكثر تفضيلا وامتيازا من الناحية التشريعية وخاصة مع نقص السيولة واتساع رقعة التجارة. لذلك تدخلت التشريعات من أجل إيجاد أنظمة وقواعد قانونية محكمة، إذ وضعت شروط في سبيل تسهيل تداولها من شخص إلى آخر،كما سعت إلى تسهيل عملية الوفاء بهذه الأوراق التجارية وذلك بزيادة الضمانات التي تلزم المدين بالوفاء بالتزامه الصرفي. The economic transactions and their development in recent times, and the urgent need to find effective tools that enhance the speed and credit between the economic dealers or traders in order to settle their debts, and I found the commercial papers (the cashier, the check) as the most preferred and privileged tools from the legislative point of view, especially with the lack of liquidity and the expansion of the area of trade. Therefore, legislation intervened in order to create strict legal systems and rules, as it set conditions in order to facilitate its circulation from one person to another, and also sought to facilitate the process of fulfilling these commercial papers by increasing the guarantees that oblige the debtor to fulfill his exchange obligation.
