أهمية العقوبات البديلة على صحة السجناء في ظل الأزمة الصحية كورونا

الملخص
أمام عجز العقوبات السالبة للحرية قصيرة المدة عن تحقيق أغراضها في الإصلاح والتأهيل واعادة إدماج المساجين، حذا المشرع الجزائري حذو التشريعات الأخرى وتبنى بدائل عقابية كأساس للسياسة العقابية الحديثة كوسيلة لإصلاح وتأهيل المحكوم عليهم، وجعلها أولوية لمواجهة الحياة العامة تتناسب مع شخصية المجرم الإنسانية، وتبعا لذلك تهدف هذه الدراسة إلى توضيح دور العقوبات البديلة في ظل الظروف الصحية الاستثنائية في التصدي للوباء من خلال الإجراءات المعتمدة كالتباعد الجسدي وشروط النظافة. تم الإعتماد على المنهج الإستقرائي التحليلي، ومن بين النتائج المتوصل إليها القول أن العقوبات السالبة للحرية أصبحت تفرض نفسها كحل أساسي للمشاكل المرتبطة بالعقوبات التقليدية السالبة للحرية بسبب الصعوبات الناجمة عن وضع المؤسسات العقابية وتحديات إصلاح وإعادة إدماج المحبوسين. Faced with the inability of short-term custodial penalties to achieve their purposes of reform, rehabilitation and reintegration of prisoners, the Algerian legislator followed the example of other legislation and adopted punitive alternatives as a basis for modern penal policy as a means of reforming and rehabilitating convicts, and making it a priority to confront public life commensurate with the criminal’s human personality, and accordingly aims This study aims to clarify the role of alternative punishments in light of the exceptional health conditions in dealing with the epidemic through approved measures such as physical distancing and hygiene conditions. The analytical inductive approach was relied upon, and among the results reached was to say that the penalties of deprivation of liberty have become imposing themselves as a basic solution to the problèmes associated with the traditional penalties of deprivation of liberty due to the difficulties arising from the situation of penal institutions and the challenges of reform and reintegration of prisoners
