ضمانات العقوبة الإدارية في التشريع العماني " قانون الجمارك نموذجاً" دراسة تحليلية مقارنة

الملخص
تعاني أغلب التشريعات من التضخم التشريعي في السياسة الجنائية مما دفع بعض التشريعات إلى منح الإدارة سلطة توقيع العقوبة الإدارية على المخالفين، ولكن مع وضع ضوابط وشروط يجب على الإدارة أن تحترمها، وهنا تكمن أهمية البحث في إيضاح الضمانات التي يجب توافرها أثناء تطبيق العقوبات الإدارية، الأمر الذي دفعنا إلى التساؤل الرئيسي وهو إلى أي مدى تمكن المشرع العماني من توفير الضمانات التي تحمي حقوق الأفراد أثناء توقيع العقوبة الإدارية من طرف الإدارة في قانون الجمارك الموحد؟، وقد اتبعنا في البحث للإجابة عليه المنهج الوصفي التحليلي، مع الاستعانة بالمنهج المقارن في فقرات البحث، وقد توصلنا إلى نتيجة مفادها يحترم المشرع في قانون الجمارك الموحد غالبية القواعد الإجرائية بالرغم من عدم النص على أغلبها صراحة، كما أوصينا المشرع العماني إلى تبني نظام متكامل للقانون الجزائي الإداري، على غرار التشريعات المقارنة كالقانون الفرنسي، بحيث يكون التنظيم شامل لجميع ضمانات وشروط وأسس تطبيق العقوبات في المجال الإداري.. Administrative Punishment Guarantees in Omani Legislation "Customs Law as a Model" Comparative Analytical Study Most legislation suffers from legislative inflation in criminal policy, which prompted some legislation to grant the administration the authority to impose administrative punishment on violators. But with sitting controls and conditions that the administration must respect. Here comes the importance of research in clarifying the guarantees that must be available during the application of administrative penalties. Which leads us to the main question is to what extent the Omani legislator was able to provide guarantees that protect the rights of individuals during the imposition of administrative punishment by the administration in the unified customs law? In the research, we followed the analytical descriptive approach to answer it, with the help of the comparative approach in the paragraphs of the research. We concluded that the legislator in the unified customs law respects the majority of procedural rules despite not explicitly stating most of them, as we recommended the Omani legislator to adopt an integrated system of criminal law Administrative law, similar to comparative legislation such as French law, so that the regulation includes all guarantees, conditions and bases for applying penalties in the administrative field. - [ ] Keywords Administrative Punishment, Administrative Penal Law, Customs Law
