الآثار المترتبة عن الزواج الدولي

الملخص
يتمحور موضوع الدراسة حول مسألة الآثار المترتبة عن الزواج الدولي، حيث قد تبين من خلال هذا البحث أن الزواج الدولي هو كل زواج يبرم في الدولة أو خارجها بين شخصين أحدهما يحمل الجنسية الدولة التي ينتمي إليها وآخر يحمل جنسية دولة أجنبية ونظرا لحساسية هذا النوع من الزيجات الذي قد يكون في شكل عقد صحيح اتبع فيه المتعاقدين جل الشروط المنصوص عليها في هذا الشأن، وقد يكون غير صحيحا في حال تلاعب المتعاقدين بذاتية العقد أو إجراءاته. وعلى الرغم من ذلك فإن هذا العقد مرتب لمجموعة من الآثار القانونية منها ما هو متعلق بالمتعاقدين ومنها ما هو متعلق بالغير الناتج عن هذه العلاقة، إلى جانب آثار أخرى تمس ذاتية العلاقة الزوجية التي قد تعرضها إلى فك الرابطة الزوجية بسبب ما اعتراه من غش نحو القانون الوطني أو إبرام العقد في شكل زواج صوري أو كان فاقد لركن من أركانه الأساسية أو بعض الشروط المتعلقة بصحة العقد. The subject of the study revolves around the issue of the effects of mixed marriage, as it has been shown through this research that mixed marriage is every marriage concluded in the country or outside it between two people, one of whom holds the nationality of the country to which he belongs and another holds the nationality of a foreign country and due to the sensitivity of this type of marriage, which may be in the form of a valid contract in which the contracting parties followed most of the conditions stipulated in this regard, and it may be incorrect in the event that the contractors manipulate their subjectivity Contract or its procedures. Nevertheless, this contract has a number of legal effects, including those relating to the contracting parties and others resulting from this relationship, namely children, as well as other effects affecting the subjectivity of the marital relationship, which may expose it to the dissolution of the marital bond because of fraud under national law or the conclusion of the contract in the form of a sham marriage or the loss of one of its basic elements or some conditions relating to the validity of the contract.
