Abstract
The legality of legal texts that have not been presented to the Council of State as an advisory body is of great importance in law and administrative justice ; With the evolution of the advisory function of the Council of State in comparative legal systems, the fact that legal texts and orders of a legislative nature are subject to consulting the Council of State is compulsory for the executive branch, This has led to the administrative judiciary repealing of legal texts issued by the Government without consulting the Council of State. The importance of this study is to know the legality of legal texts that have not been submitted to the Algerian Council of State as an advisory body. This is in comparison with the findings of legislation and the judiciary in comparative legal systems, particularly in Egypt and France.
