التنازع بين القانون الدولي البيئي وقانون التجارة الدولية

الملخص

يعالج هذا المقال التطور النظمي الذي عرفه القانون الدولي في الآونة الأخيرة، والذي مس قواعد دولية للتجارة والبيئة على حدّ سواء، حيث تعارضت هذه الأخيرة خصوصا بعد إبرام اتفاقيات التجارة الدولية تحت إشراف منظمة التجارة الدولية، ويظهر التنازع جلّيا بين بروتوكول قرطاجنة بشأن السلامة الإحيائية التابع للاتفاقية المتعلقة بالتنوع البيولوجي وإتفاقية G.A.T.T المنشأة للمنظمة العالمية للتجارة، الأمر الذي يؤثّر بشكل مؤكّد على الأمن القانوني . يتطلب هذا الوضع إقحام آليات قانونية جديدة ومُبتكرة من قبيل الاندماج النظمـي لاسيما قاعــدة التخصص وقاعدة اللاحق يقيد تطبيق السابق وكذا التسلسل الهرمي لقواعد القانون الدولي، غير أنّ تطبيق هذه الآليات يستدعي إحداث تغيير هيكلي في قواعد القانون الدولي بشكل عام وصياغة قواعد ضمن النظامين محل التنازع تهدف الى ايجاد حل لمثل هذا التنازع . This article addresses the recent systemic development of international law international trade and environment ", which extended to international rules on both trade and environment, as the latter were particularly opposed by international trade agreements concluded under the umbrella of the World Trade Organization (WTO). For example, there is a glaring conflict between the Cartagena Protocol on Biosafety of the Convention on Biological Diversity and the Terbis Convention on Intellectual Property Rights of International Trade Conventions, which has a definite impact on legal security. Thus, this situation requires the introduction of new and innovative legal mechanisms such as systemic integration, the specialization base and the subsequent rule restricting the application of the precedent as well as the hierarchy of rules of international law. However, the application of such mechanisms requires structural change in the rules of international law and the formulation of rules within the two regimes of conflict aimed at resolving such a conflict
