خطوات ومراحل عملية مسح الأراضي في ظل التشريع الجزائري

الملخص
تعتبر عملية المسح الأداة الحقيقية والفعالة لتحديد الملكية العقارية، فهي عملية فنية وقانونية تهدف إلى وضع هوية للعقار عن طريق تحديد وتثبيت مواقع العقارات وتحديد أوصافها الكاملة وتعيين الحقوق المترتبة لها أو عليها، والتعريف بالأشخاص المترتبة لهم هذه الحقوق، إلا أن ذلك لا يمكن أن يتجسد ميدانيا إلا من خلال آليات تعمل وتسعى على تحقيقه، فالمسح يتحقق من خلال جملة من الخطوات والمراحل، منها ما هو تحضيري على مستوى المكاتب وأخرى ميدانية وعملية. الأمر الدي يجعلها تواجه مجموعة من الصعوبات التي قد تعرقل مهمتها، مما يدفعنا الى دراسة هده الخطوات والتعرف على هاته العراقيل من اجل إعطاء بعض الحلول للقضاء عليها أو محاولة للحد منها. The survey process is considered the real and effective tool for determining real estate ownership. It is a technical and legal process that aims to establish the identity of the real estate by locating and fixing the locations of the real estate, defining their full descriptions, assigning the rights due to them, and defining the people who have these rights. However, this cannot be done. It is only embodied in the field through mechanisms that work and seek to achieve it. The survey is achieved through a number of steps some of which are preparatory at the level of offices are field and practical. The matter that makes her face a set of difficulties that may hinder her mission, which prompts us to study these steps and identify these obstacles to give some solutions to eliminate them or try to reduce them.
