انتهاكات حق اللجوء في ظل الأوضاع الدولية الراهنة

الملخص
ملخص ليست الحرب وحدها هي من تنتهك حقوق الإنسان، فهذه الحقوق هي محل انتهاك في العديد من دول العالم إما بسبب الدكتاتورية أو بسبب الحروب الأهلية والصراعات الداخلية أو بسبب عدم الاستقرار السياسي (ليبيا حاليا وسوريا) والأمني في الدول، سواء كانت هذه الانتهاكات موجهة ضد جماعات عرقية أو دينيه أو إثنية أو سياسية أو إلى معارضين سياسيين لنظام الحكم، مما يضطر هؤلاء سواء كانوا أفرادا أو جماعات إلى الفرار طلبا للجوء الآمن خارج بلدانهم، وبهذا يتحول الإنسان من مواطن يفترض أنه سيد داخل مجتمعه إلى لاجئ مشرد خارج وطنه. وبغية تقنين ظاهرة اللجوء سعى المجتمع الدولي من خلال اتفاقية اللاجئين لعام 1951 أو من خلال بعض الاتفاقيات الإقليمية إلى تحديد الأسباب الداعية إلى طلب اللجوء ومن ثم تحديد التزامات كل من دولة المنشأ ودولة الملجأ واللاجئ بحد ذاته حتى لا تكون حقوق اللاجئ محلا للانتهاكات من قبل الدول، ومع ذلك كشفت لنا الأوضاع الدولية الراهنة انتهاك هذه الحقوق في كثير من الدول. Abstract It is not only war that violates human rights. These rights are violated in many countries of the world, either because of dictatorship, civil wars and internal conflicts, or because of political instability (currently Libya and Syria) and security in countries, whether these violations are directed against ethnic groups. Religious, ethnic, political, or political opponents of the ruling regime, forcing them, whether individuals or groups, to flee in search of safe asylum outside their countries, and thus transforming a person from a citizen who is supposed to be a master within his society to a displaced refugee outside his homeland. In order to legalize the phenomenon of asylum, the international community sought, through the Refugee Convention of 1951 or through some regional agreements, to define the reasons for seeking asylum, and then define the obligations of each of the country of origin, the country of refuge, and the refugee itself, so that the rights of the refugee are not the subject of violations by states, However, the current international situation revealed to us the violation of these rights in many countries.
