آليات حماية الممتلكات الثقافية العقارية في القانون الجزائري بين الوقاية و الجزاء

الملخص
حظيت الممتلكات الثقافية العقارية بمكانة و حماية وطنية و دولية خاصة ، و القوانين و القرارات التي تؤكد على ذلك كثيرة ، و ذلك نتيجة الوعي بضرورة الحفاظ على هذا المكون الحضاري الذي أصبح اليوم مهددا نتيجة لما يشهده العالم من إنتهاك لهذا الرصيد الثقافي المميز . لهذا سعى المشرع الجزائري لحماية هذه الممتلكات بموجب ما ورد في القانون 98-04 المتعلق بحماية التراث الثقافي ، من خلال تكريس حماية إدارية للحفاظ عليها و تثمينها وذلك بوضع هذه الممتلكات تحت سلطة الدولة ، بالإضافة إلى دمج الأملاك الثقافية العقارية المملوكة للخواص في الأملاك العمومية التابعة للدولة بإتخاذ مختلف الوسائل مثل نزع الملكية ، كما أقر حماية جزائية و فرض عقوبات قاسية كوسيلة ردعية لكل مرتكبي الجرائم الماسة بهذا الموروث . Real estate cultural property has enjoyed a special national and international status and protection, and there are many laws and decisions that confirm this, as a result of the awareness of the need to preserve this cultural component, which today has become threatened as a result of the violation of this distinctive cultural asset that the world is witnessing. That is why the Algerian legislator sought to protect these properties according to what was stated in Law 98-04 related to the protection of cultural heritage, by devoting administrative protection to their preservation and valorization by placing these properties under the authority of the state, in addition to merging the real estate cultural property owned by private persons in the public property of the state. By adopting various means such as expropriation, and also approved penal protection and the imposition of harsh penalties as a means of deterrence for all perpetrators of crimes related to this heritage.
