أثر عدم التوازن المعرفي في العقد الطبي

الملخص
الملخص: تعالج هذه الدراسة مسألة غاية في الأهمية تتمثل في اختلال التوازن في العلم والمعرفة بالبيانات والمعلومات المتعلقة بالعقد الطبي بين الطبيب والمريض أثناء مرحلة تكوين العقد، وقد حاولنا أن نقف عند دراسة البعد التعاقدي للعلاقة التي تربط الطبيب مع مريضه التي تقوم على مبدأ سيادة إرادة المتعاقدين ومبدأ حرية التعاقد، والنتائج المترتبة عن ذلك، مع بيان الحلول التشريعية لمواجهة هذا الاختلال، ولعل أهمها تقرير التزام بالإعلام قبل التعاقد يقع على عاتق الطبيب لأنه يتفوق بالعلم والخبرة على المريض. Abstract: This study deals with a very important question represented by the imbalance between science and knowledge with data and information relating to the medical contract between the doctor and the patient during the training period of the contract formulation parameterization of the contract, we have tried to study the contractual dimension of the relationship between doctor and patient, which is based on the principle of the sovereignty of the will of the contracting parties and the principle of contractual freedom, and its consequences, with a statement of legislative solutions to address this imbalance, and perhaps the most important of them is the determination of a commitment to inform before contracting, It is the responsibility of the physician to excel in the knowledge and experience of the patient.
