الأضرار الناجمة عن أشغال ومنشآت الطرق العمومية: أيّ أساس للمسؤولية ؟

الملخص
تندرج هذه الدراسة ضمن المسؤولية الإدارية عن الأشغال والمنشآت العمومية، بحيث تهدف إلى البحث عن أساس المسؤولية عن الأضرار الناجمة عن أشغال ومنشآت الطرق العمومية، وذلك بتقصّي الحالات والوضعيات والمعايير والأسس المطبّقة من طرف القضاء الإداري باستخدام منهج تحليلي ووصفي اعتمادا على منهج مقارن بالقضاء الفرنسي. وتوصّل الباحث إلى بعض النتائج؛ أهمّها أنّ القضاء الجزائري تراجع نسبيا عن معيار وضعية الضحية بتوحيده للخطأ المفترض بالنسبة لمستعملي الطرق وللغير بخصوص الأضرار العرضية الحادثة له بعد أن كان مستقرّا على نظام المخاطر، مع احتفاظه بالمسؤولية عن قطع المساواة بالنسبة لمضارّ جوار أشغال الطريق العمومي رغم عدم وضوحه وصراحته. أمّا القضاء الفرنسي فقد أنتج نظاما تتعايش فيه أسس المسؤولية بسبب حمايته لمستعملي الطرق بنظام المخاطر أحيانا، وتخلّيه عن خصوصية وجسامة الضرر العرضي الواقع على الغير. This study falls within the administrative responsibility for public works and structures, as it aims to search for the basis of responsibility for damages caused by public road works and structures, by investigating the cases, situations, criteria and foundations applied by the administrative judiciary using an analytical and descriptive methodology based on a comparative approach to the French judiciary. The researcher reached some results; the most important of which is that the Algerian judiciary has relatively retreated from the criterion of the victim situation by unifying the fault assumed for road users and others regarding accidental damages caused to him after it was stable on the risk regime, while retaining responsibility for cutting equality with regard to the harms of the vicinity of public road works, despite its lack of clarity and frankness. However the French judiciary has produced a regime in which the foundations of responsibility coexist because of its protection of road users with a regime of risks sometimes, and its abandonment of the specificity and gravity of accidental damage caused to third persons.
