المجلس الدستوري الجزائري – النشأة والتشكيلة- من سنة 1963 إلى سنة 2016

ملخص: تهدف هذه الدراسة إلى بيان نشأة وتشكيلة المجلس الدستوري الجزائري قبل أن يتم إلغاؤه بموجب التعديل الدستوري الأخير لسنة 2020 واستبداله بالمحكمة الدستورية، فالمؤسس الدستوري إنما تبنى مبدأ الرقابة على دستورية القوانين ومنح صلاحية مراقبتها والدفع بعدم دستورية أي نص قانوني مخالف لوثيقة الدستور للمجلس الدستوري. هذه الهيئة قد مرت بعدة عوامل وظروف سياسية أدت إلى تغيرها وتطورها بدءاً بدستور سنة 1963 الذي عُطلَ العمل به، ثم دستور 1976 ذو التوجه الاشتراكي حيث أنه لا يرى مكانة لهذه الهيئة، فدستور 1989 الذي أسس لمجلس دستوري وعُلقتَ عليه آمال كبيرة في تكريس مبدأ الرقابة على دستورية القوانين وصولاً إلى دستور سنة 1996 الذي هو الأخر أبقى على هذه الهيئة مع اختلاف في التشكيلة وشروط العضوية فيها وهو ما تجلى كذلك في التعديل الدستوري لسنة 2016. Abstract : This stady aims to know the emergence and composition of the Algerian Constitutional Council, befor it was canceled it in the last constitutional amendment of 2020, and replaced by the Constitutional Court. The constitutional founder gave the Constitutional Council the power to monitor the constitutionality of laws, and the defense of the uncounstitutionaliy of any legal text that is countrary to the Constitution. This institution noticed several political condition, that led to its development, starting with the 1963 constitution, wich was suspended, Then the 1976 constitution wich has a socialist orientation, does not see a place for this institution, Also the 1989 constitution estabilished a constitutional council and estabilished the principale of oversight over the constitutionality of laws, up to the 1996 constitution which retained it with a defference in the comopsition, conditions and membership which was evident in the 2016 amendment. Résumé : Cette étude vise à expliquer la mise en place et la formation du Conseil constitutionnel algérien avant qu'il ne soit aboli par le dernier amendement constitutionnel de 2020 et remplacé par la Cour constitutionnelle. Cet organe a traversé plusieurs facteurs et conditions politiques qui ont conduit à son changement et à son développement, à commencer par la constitution de 1963, qui a suspendu ses travaux, puis la constitution de 1976 à orientation socialiste, car elle ne voit pas de place pour cet organe, et la constitution de 1989, qui a institué un conseil constitutionnel et de grands espoirs ont été placés en lui pour pérenniser le principe de contrôle de la constitutionnalité des lois jusqu'à la constitution de 1996, qui a également maintenu cet organe avec une différence dans la composition et les conditions d'adhésion à celui-ci , ce qui était également évident dans l'amendement constitutionnel de 2016.
