تطور مجال خدمات النقل الجوي العمومي عن طريق عقود الإلتزام

الملخص
يعد عقد الامتياز أحد ا لطرق القديمة في إدارة المرفق العام بطريقة غير مباشرة ، و التي تمكن افراد القانون الخاص من المساهمة في تنمية الاقتصاد الوطني عن طريق تقديم الخدمات التي من شانها تلبية الحاجات العامة للجمهور، و التي غالبا ما يكون لها الطابع الصناعي و التجاري ، و بصدور القانون رقم 96/06 و الذي يحدد القواعد العامة بالطيران المدني فتح المجال امام القطاع الخاص لاستغلال الخدمات الجوية بجميع أنواعها ، و بما انا الخدمات الجوية للنقل العمومي تعد أساس إدارة مرفق النقل الجوي فقد اهتم المشرع الجزائري بتنظيم كافة الجوانب المتعلقة بها حيث اعتمد كأسلوب لاستغلالها و ذلك باشراك القطاع الخاص في تحسين خدمات النقل الجوي . The concession contract is one of the old ways of managing the public utility in an indirect way, which enables the individuals of the private law to contribute to the development of the national economy by providing services that meet the general needs of the public, which often have an industrial and commercial nature. And with the issuance of the law No. 96/06, which defines the general rules for civil aviation, opened the way for the private sector to exploit air services of all kinds, and since air services for public transport are the basis of the air transport facility, the Algerian legislator was interested in organizing all aspects related to it, as it was adopted as a method for its exploitation and with the involvement of the private sector in improving air transport services
