الحمولة القيمية للســـؤال في الشريعة الإســـلامية Question And Value In Islamic Law

الملخص
نبحث في هذه الورقة عن الأبعاد القيمية للسؤال في الشريعة الإسلامية، فعرفنا السؤال وذكرنا أهميته وخصائصه؛ وعرجنا على أهم الضوابط الواجب مراعاتها أثناء المساءلة والمباحثة، لبيان الإشكالية التي طرحناها: هل للسؤال في الشريعة الإسلامية ضوابط محددة ينبغي الالتزام بها؟ أم أن الأمر مطلق للعقل أن يسأل ما بدا له ويباحث ويناقش؟؛ ما هي الأبعاد القيمية للسؤال في الشريعة الإسلامية؟ وما أثرها على واقع الناس؟. واستعنا بالمنهج الاستنباطي والتحليلي، وخلصنا في نتائج الدراسة إلى أنَّ: السؤال في الأصل طلب المعرفة والبحث والتقصي عنها، ولا معرفة دون سؤال، فهو مقدمة تصلح بها النتيجة؛ وأنَّ له عدَّة خصائص لا تنفك عنه، وأنَّ السؤال ينقسم في الشريعة إلى قسمين: سؤال فرض عين وهو واجب السؤال عنه وسؤال فرض کفاية يكفي أن تعرفه جماعة دون جماعة، وأنَّ له عدة أبعاد قيمية تتشكل في الأخير لترسم معالم واضحة للنظام الأخلاقي الذي تحتويه الشريعة. In this research paper, we are looking at the value dimensions of the question in Islamic law, so we defined the question and mentioned its importance, characteristics and controls; and we reviewed the most important controls to be observed during accountability and discussion, to clarify the problem that we raised: does the question in Islamic law have specific controls Or is it permissible to leave the mind on its own, asking what seemed to him, discussing and discussing What are the value dimensions of the question in Islamic law And what impact does it have on people's reality, we used the deductive and analytical approach, and we concluded in the results of the study that: the question is originally a request for knowledge, research and investigation, and there is no knowledge without a question, it is an introduction that fixes the result; and that it has several characteristics that are inseparable from it, or the question is divided into two parts in the Sharia, and that it has several value dimensions that are formed in the latter to draw clear contours of the moral system contained in the Sharia.
