الملخص

يعتبر وكيل السفينة كوكيل لخدمات النقل البحري بمثابة القلب في جسد النقل البحري، فهو وكيلا للمجهز، فتقع على عاتقه وظائف فيؤديها بكفاءة عالية فيفيد بها أصحاب البضائع من شاحنين ومستلمين من جهة، والأجهزة المسؤولة في الموانئ وشركات الخدمات البحرية العاملة بها في مجال شحن وتفريغ البضائع وتخزين وتداول الحاويات من جهة أخرى، وبما أن العقد ملزم للجانبين فإذا ما أخل أحد بالإلتزامات الموكلة له فإن ذلك سيعرضه لمسؤولية تعاقدية أو تقصيرية. كما لا يخلو دور المشرع الجزائري في إبراز أهمية وكيل السفينة في خدمات النقل البحري في الجزائر.
