دور الجمعية العامة للأمم المتحدة في تطوير قواعد القانون الدولي

الملخص
لقد تكفلت الجمعية العامة للأمم المتحدة بالعمل من أجل تطوير وإنماء قواعد القانون الدولي، حيث منح نص المادة 13 فقرة أ، الجمعية العامة للأمم المتحدة اتخاذ الخطوات اللازمة لتدوين القانون الدولي وإنماءه، وهذا لا يقتصر على مفهوم القانون الدولي في صورته التقليدية، وإنما يعني إنماء قواعد القانون الدولي وتطويره في سياق مفهوم الميثاق، حيث العديد من التوصيات والقرارات الصادرة عن الجمعية العامة تندرج في سياق عملية تكوين القاعدة القانونية التي لم تعد بحاجة إلى إثبات من خلال الكشف عن أساليب هذا الدور الذي يتراوح بين استعمال الطرق الاتفاقية في إعداد القانون الدولي وبين استعمال الطرق المباشرة التي تتخذ شكل سلطة تقريرية أو شكل سلطة تنظيمية، وسنتناول من خلال دراستنا هذه دور قرارات الجمعية العامة وتأثيرها على قواعد القانون الدولي خاصة القواعد العرفية الدولية، وكذا إسهامات الجمعية العامة في تطوير قواعد القانون الدولي وتقنينه. The General Assembly of the United Nations has undertaken to work for the development of the rules of international law, as the text of Article 13, paragraph A, gives the General Assembly of the United Nations to take the necessary steps to codify and develop international law, and this is not limited to the concept of international law in its traditional form, but rather means the development of the rules of law and its development in the context of the concept of the Charter, where many of the recommendations and decisions issued by the General Assembly fall within the context of the process of forming the legal base that no longer needs to be proven by revealing the methods of this role, which ranges between the use of conventional methods in the preparation of international law and the use of direct methods that take the form of a decisional authority or a form regulatory authority. Through our study, we will discuss the role of General Assembly resolutions and their impact on the rules of international law, especially the customary international rules, as well as the contributions of the General Assembly to the development and codification of the rules of international law.
