الملخص
ملخص عادت مسألة الدفع بعدم الدستورية التي أهملها القضاء إلى الظهور مجددًا في دستور 2020 مع سلسلة من التقلبات والتحديات للسلطة القضائية في البلاد. بين قلة خبرة القاضي في تفسير وتأويل القانون بما يوافق النص الدستوري وبين متطلبات العقيدة القانونية والاجتهادات الفقهية والفقه قضائية الحديثة والتي أنتجت مفاهيم جديدة في الإجراءات الدستورية، ومن أجل سلاسة الانتقال من قاض دستوري تقليدي إلى قاض دستوري يضمن سمو القاعدة الدستورية التي بما يتوافق مع تمليه المعايير الحديثة مقابل باقي القواعد، حيث يعتبر مبدأ التأويل المطابق للدستور والمبادئ المتعلقة به أمرًا ضروريًا لتوجيه أعمال القاضي الدستوري الجزائري كحامي للدستور من جهة وضامن للحقوق من جهة أخرى. الأمر الذي يدعو للتساؤل حول الأدوات التي يستعين بها القاضي الدستوري في قراره وكيفية استخدامها في مقابل المعايير الدستورية الكلمات المفتاحية: الدفع بعدم الدستورية، تأويل القانون، التأويل المطابق مع الدستور، تفسير القاضي Abstract: The issue of arguing unconstitutionality, which was neglected by the judiciary, re-emerged in the 2020 constitution with a series of fluctuations and challenges to the judicial authority in the country. Between the lack of experience of the judge in interpreting the law in accordance with the constitutional text and between the requirements of legal doctrine, jurisprudence and modern jurisprudence, which have produced new concepts in constitutional procedures, and in order to smooth the transition from a traditional constitutional judge to a constitutional judge that guarantees the supremacy of the constitutional rules with modern standards compared to the rest of the rules, The principle of interpretation conforming to the constitution and the principles related to it is considered necessary to guide the work of the Algerian constitutional judge as a protector of the constitution and guarantor of rights .
