Investment Crimes And Means Of Combating Them In Algerian Legislation - A Study In The Light Of Ordinance 22/18 On Investment And Penal Codes -

Abstract
Abstract: Investment crimes are multifaceted. In view of an overwhelming desire for rapid wealth and profit, some investors may engage in illegal acts.Some abuses may as well occur by the state or people against investors and the investment process in general,which adversely affects the economic development and financial recovery, forcing Algerian legislators to establish legal protections for the investment activity to create a secure investment space that attracts domestic and foreign capital, and dispels investors' concerns. This paper will therefore include the mechanisms founded by the Algerian legislator in the field of investment crimes,prevention, and the means to combat them. This is accomplished through (1) highlighting the preventive and protective aspect that deters the occurrence of abuse, particularly under Ordinance No. 22/18 on Investment, and (2) the repressive aspect that includes the deterrent mechanisms contained in the Criminal Code, both substantive and procedural, against investment crimes provided for in the Penal Code or in certain special laws specifically enacted to protect and secure Algeria's investment climate. إن الجرائم الواقعة على الإستثمار متعددة الأنماط والأشكال، فقد يقوم بعض المستثمرين نظرا لرغبتهم الجامحة في الثراء السريع والربح بأفعال غير مشروعة، كما قد تحصل تجاوزات من قبل الدولة أو الأشخاص ضد المستثمرين والعملية الإستثمارية بشكل عام، وهو ما ينعكس سلبا على التنمية الإقتصادية والإنتعاش المالي، الأمر الذي فرض على المشرع الجزائري تأسيس حماية قانونية للنشاط الإستثماري لخلق فضاء إستثماري آمن يستقطب الرأسمال الداخلي والأجنبي، ويبدد مخاوف المستثمرين، لذلك ستتضمن هذه الورقة البحثية الآليات التي أوجدها المشرع الجزائري في مجال الوقاية من جرائم الإستثمار وسبل مكافحتها بإبراز الجانب الوقائي الحمائي الذي يجنب وقوع الإعتداء لاسيما في ظل الأمر 22/ 18 المتعلق بالإستثمار، والجانب القمعي الذي يتضمن الآليات الردعية الواردة في القانون الجنائي بشقيه الموضوعي و الإجرائي لمكافحة جرائم الاستثمار المنصوص عليها في قانون العقوبات أو في بعض القوانين الخاصة التي أصدرت خصيصا لحماية مناخ الإستثمار في الجزائر وتأمينه. الكلمات المفتاحية: جرائم الإستثمار، قانون الإستثمار، سبل الوقاية، آليات المكافحة.
